Refund policy
SAIKA Return & Right of Withdrawal Policy
This Return & Right of Withdrawal Policy applies to all distance sales concluded between SAIKA Collective (“SAIKA”, “we”, “us”, or “our”) and consumers within the meaning of Directive 2011/83/EU on Consumer Rights.
Statutory Right of Withdrawal
In accordance with Article 9 of Directive 2011/83/EU, consumers have the right to withdraw from the purchase agreement without giving any reason within fourteen (14) calendar days from the day on which the consumer, or a third party designated by the consumer (other than the carrier), acquires physical possession of the goods.
To exercise the right of withdrawal, you must notify SAIKA of your decision to withdraw from the contract by means of an unequivocal statement sent by email to:
info@saikacollective.com
Withdrawal requests submitted after the expiration of the statutory 14-day period shall not be accepted.
Condition of Returned Goods
Pursuant to Article 14(2) of Directive 2011/83/EU, the consumer shall be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
As such, any return will only be accepted where the item:
-
Remains in the exact same condition as received
-
Has not been used, worn, altered, or damaged
-
Is returned in its original packaging
-
Includes all original contents and documentation
-
Retains the original SAIKA authentication tag attached to the bag, fully intact
The SAIKA authentication tag constitutes a security and authenticity seal within the meaning of Article 16(e) of Directive 2011/83/EU.
Removal, detachment, damage, or tampering with this tag shall be deemed:
-
Handling beyond what is necessary to establish the nature and characteristics of the goods
-
A material alteration of the product
-
An explicit acceptance of the goods by the consumer
Accordingly, the removal or compromise of the authentication tag results in the forfeiture of the right of withdrawal, and the return shall be legally refused.
Return Procedure
Returned goods will only be accepted if prior written authorization has been granted by SAIKA following a valid withdrawal request submitted within the statutory period.
Items returned without prior authorization shall be rejected and may be returned to the sender at the sender’s expense.
The consumer shall bear the burden of proof with respect to the timely exercise of the right of withdrawal.
Costs and Risk of Return
In accordance with Article 14(1) of Directive 2011/83/EU:
-
The direct cost of returning the goods shall be borne entirely by the consumer
-
Original shipping costs are non-refundable
-
Any customs duties, import taxes, or related charges incurred in connection with the return shall remain the sole responsibility of the consumer
The consumer assumes all risk associated with the return shipment until the goods have been physically received and inspected by SAIKA.
SAIKA shall not be held liable for loss, theft, or damage occurring during return transit. The use of a fully insured and trackable shipping service is strongly recommended.
Inspection and Refunds
All returned goods are subject to inspection upon receipt.
SAIKA reserves the right to refuse any return that does not strictly comply with the conditions set forth in this policy.
Where a return is accepted, reimbursement shall be issued using the original method of payment within fourteen (14) days following confirmation that the returned goods comply with the applicable return conditions.
Exclusions
The right of withdrawal shall not apply to:
-
Custom-made or personalized items
-
